Legislative Update

The legislature adjourned it session this week.  This session is broadly considered the most unfriendly session towards business in history.  Our industry faces an unpreceded number of new sets of rules and regulations.  We will be having a statewide tour in the next few weeks to dive more into details than what we can provide on this quick update.  Some of the biggest pieces of legislation that were passed include, paid family medical leave, legalized cannabis, earned sick and safe time, a new gas tax which is indexed to inflation, sustainable aviation fuel, and finally the unpleasant modification to our below cost selling statute which we were able to save after being close to being fully repealed.  After it’s all said and done its likely this session will have increased the state budget by 40% and being close to spending $72 billion dollars over two years.

As mentioned earlier the below cost statute was very close to being repealed until a compromise was reached.  The compromise does two things:

  1. Repeals the 8 cents or 6% whichever is less.
    1. Retailers will now be allowed to sell at the average terminal cost (may go lower than the average if they provide proof they purchased it for cheaper and it must include freight)
  2. Codifies current market practices.
    1. Meaning that current coupon programs, loyalty programs, and member-based programs will be allowed to sell under cost.
  1. We have a commitment from legislative leaders to monitor this over the summer and if any negative impacts are seen by this they will be addressed.
